Thus, Homeowner’s disclosure of the finance charges to its borrowers was false. In some circumstances, the difference in the amount of the charges made the loans "high cost" loans under the Home Owners Equity Protection Act. The matter was settled for a lump sum cash payment of $10 million to be distributed to class members after the payment of certain fees and expenses. Class members received up to $20,000 from the settlement fund.
